Former Marine convicted of killing fellow serviceman at Camp Pendleton loses bid for high court review

A former Marine convicted in the shooting death of afellow serviceman in a dispute over stolen drug money lost his bid to have the state's high court review his case, court papers show.

The California Supreme Court on Thursday declined to take on Christian William Carney's appeal of his Dec. 20, 2011, first-degree murder conviction in the death of 20-year-old Stephen Serrano, who was driven to a secluded area of San Clemente and shot in May 2008.

The Fourth District Court of Appeals, which rejected Carney's appeal last December, issued a final case completion order today in light of the high court's ruling.

Carney's appellate attorneys argued their client should get a new trial because prosecutors were allowed to introduce gang-related evidence and a pathologist who did not perform the autopsy testified.

on May 18, 2012, and was immediately sentenced to 15 years in prison.

Carney was sentenced in March 2012 to 28 years and eight months to life behind bars.

Carney and Lovely suspected that Serrano and an accomplice -- Chad Hatch -- had broken into Carney's room at Camp Pendleton and stolen money Carney made by selling cocaine and ecstasy, according to prosecutors.

When they discovered the theft, Carney and Lovely drove Hatch to a secluded area of San Clemente on May 18, 2008, pointed a gun at his head and threatened to kill him, prosecutors said. Hatch, however, blamed Serrano.

Carney and Lovely then drove Serrano to another area and shot him once in the face and three times in the back, according to trial testimony. Carney then met with Hatch and told him not to discuss what happened to Serrano,

according to prosecutors.

We teach these young men to be savage killers and then we're surprised when they act out on it? I agree with #1 above.

@Comment #3: That statement is idiotic. We also teach cops to "kill" if need be. Does that make them savage killers? If a person is a killer it is on them, they have to own it, stop blaming the profession instead of the individual. I know lots of Marines, not one of them is a savage killer. As for Lee, he makes up dumb statements as he goes along. I agree with Paul. No one takes him seriously anymore.

To Lee and Sycamore Ranch homeowner: What did you two do as a profession? Bet you that whatever it was- lawyer, welfare cheat, mechanic, you also had "bad apples" that killed, did drugs etc. Why is it always "Marine does...."? One reason is it still a shock to us (Marines, former Marines, and normal citizens) when one of us (Marines) go bad. Did you notice the article concerning the Marines who came to the defense of the female Angles fan attacked by Dodger fans? They (the Marines) were stabbed in her defense. The Marines are not taught to be mindless "savage killers"; Marines, and their army brothers, are taught to kill when required of course, but they are trained to inflict as little damage or death on non-combatants as possible. You should feel much safer around a group of Marines than almost any other group of people - preachers being one exception - they are pretty safe too. Let me ask you – would you travel on foot, alone, in the dark through all populated parts of Vista, Fallbrook? I would not. Would you at Camp Pendleton? Of course, have done it .

Nice labeling Sycamore Ranch resident, if you were to accuse any other group of people of something equally horrendous, you would be called a bigot... wait, you are a bigot. Lee apparently isn't intelligent enough to be called anything, except perhaps, silly. Wonder how both of you feel about the woman a few weeks back who murdered her military son in law in cold blood. Do you believe that all mothers in law are crazed killers?

Another one of America's fine uniformed "defenders" goes bezerk at Ft. Hood shoots up a bunch of people leaving 4 dead. Do I feel safer or what?

These Marines were not in their right mind set. When you add any drugs into any equation, all right and moral sense goes right out the window. People who are involved in drugs become different in the head and the way their thought process is. Its a shame that all of our tax payer money spent on training these individuals to protect our country is wasted. Sure you can call them a few "bad apples", but think of the other Marines this guy sold these drugs to. I think the government should do random drug testing and if they already are doing so, then make them more frequent. We dont want another Fort Hood to happen in our own backyard or anywhere for that matter. Even though the shooter at Fort Hood had suffered from PTSD, its similar to when people take drugs. It makes people do really bad things.

There are evil people is this world that want to hurt/kill other people - they can join the military - it is their right. THE MILITARY DIDN'T MAKE THEM WANT TO KILL, they already wanted to and now, they get to fulfill their crazy ambition. -in reference to this article, not Ft. Hood.
