Clarifying a property owner’s right and the role of the planning group

It is often difficult when a town loses a long time business. Such is the case with the Happy Jug Liquor store, the Smog Bros., and the Main Place Bar. Their current locations will be torn down and replaced by a new McDonald’s. This change will be unpleasing to many.

As with many other Fallbrook businesses, these owners have helped support many community activities. For this we are very grateful.

However, an important fact we wish to underscore is that these businesses do not own the property. They rent on a month-to-month basis. It was the property owner’s decision to discontinue renting to them and sign a long-term lease with McDonald’s.

As members of the Fallbrook Community Planning Group, we are not unsympathetic to the owners of these businesses. We listened to their concerns. But essentially, there was nothing that we could do. A property owner has the right to rent or lease or not rent or lease to whomever they choose.

Regardless of how we personally feel about the new McDonald’s, our job is to review a project for compliance with County requirements. McDonald’s fulfilled all of the County’s requirements.

We hope that these businesses will be able to relocate to a new location and continue to do business and serve the community as they have in the past. We also hope that the new plans for this intersection will serve the entire community.

Who are you trying to kid? We all know putting McDonald's on that corner is going to be a huge nightmare and will affect everyone in Fallbrook 1 time or another. The Planning Commission had a choice. and yoou chose to let that big corporation in our small town. On the busiest corner in Fallbrook. You also chose to put 3 small businesses out. when this is all said and done you'll have so many complaints you won't be able to sleep at night.

First of all "Pro Dive" (hmmmm) they are not a planning commission, they are a community planning group. Big difference. They have no authority to turn a project down that meets all county requirements (which this one does) even if they personally don't like it, they are there only to make sure that it is in compliance. Also they cannot tell a property owner to whom he can and cannot sell or lease too. Unfortunately the businesses located there now are on a month to month contract which means the owner that replace them with someone else with bigger bucks, once again, may not be right, but it is legal. The planning groups hands were tied. The county had already pre-approved this project because it is zoned correctly. By the way, McDonald's didn't just sneak into town in the dead of night, they have been here for over 30 years. We also have a Burger King, Taco Bell, Jack in the Box, etc. All corporation businesses. There will most certainly be traffic issues but only in the very early morning (went by there at 8am today, hardly any cars) and late afternoons when Pendleton lets out, otherwise, traffic isn't much at that intersection. The county is one who has to sign off on the traffic review. You are blaming the wrong people. As far as complaints go, after the initial brough haha it will all die down and go away and people will be lined up for their daily intake of calories and cholesterol.

All of the folks who expressed their concerns were not impressed by the condescending way we were treated by the Community Planning Group. The snide comments and attitude towards community members who expressed concerns was unprofessional. Not saying the entire Planning Group was rude, only a few. They know who they are. But what a surprise McDonald's is in for- the entire parking lot is contaminated. The Dept. of Environmental Health recently discovered the issue. Hopefully they will have enough money to fix that. Otherwise the property owner will have to. And no, McDonald's didn't just sneak into town. Duh- really??? Now we know which Planning Group Member wrote that comment!

@comment#3: I'm not a Planning Group member, never have been, I'm just a realist. McDonald's has been in town for over 30 years, the FCPG didn't let them in as "pro dive' suggests, they are already here! How is that anything to get your knickers in a twist about? I was stating a fact. I feel bad about the businesses that will have to go but it is what it is. Money talks. BTW I agree that certain members of the planning group could and should learn some manners.

Which parking lot is contaminated? The liquor store/smog shop or the bar? What is it contaminated with? I'm betting that the owner will have to deal with that issue before McDonald's will sign the lease.... that could be a deal breaker. Wonder if it was caused by the grease from the illegal taco cart.....

So I'm guessing that since "condescending" hasn't replied and the VN hasn't done an article on it that the claim about the parking lot being contaminated is bogus? Guess so.

Sure Pink, everyone is a liar. Hazmat randomly shows up at area businesses to test for contamination. Gasoline (from the gas station) is what contaminated the (pavement/earth below the pavement.) But that's ok, I know the truth. Conduct your own investigation if you wish. Or not- many people doubt everything a person ever says. That's fine. There's nothing wrong with that. You can give someone "the benefit of the doubt," or believe they are lying. I'm guessing you are more "I'll believe it, only if I see it" individual. (Not knocking you whatsoever here-you are entitled to your opinion)

I apologize condescending, but if you will check my post it was over a week ago. I even suggested to the VN that it could be a deal breaker for McDonald's and might be worth a story. Neither you (whoever you are) or the VN replied with ANY of this information so I assumed it might have been a false report. I don't think I said anything to make you this upset. All you had to do was answer. As for gasoline contamination?? In my opinion this could keep McDonald's from wanting that location, also have heard that there are issues with the right of way across the parking lot.
