Scuffle outside bar leaves one man injured

A late night scuffle outside of a Fallbrook bar left one man hospitalized, according to Sheriff’s deputies that responded to the call.

On Saturday, Jan. 28 at approximately 12:30 a.m., deputies responded to a call regarding ten subjects fighting. Upon arriving at the bar located in the 1400 block of South Mission Rd., deputies found one subject bleeding on the ground, with lacerations on his face and head. According to witnesses, the victim had been kicked and punched by other suspects, who then fled in vehicles before deputies could arrive.

"The victim was conscious, but uncooperative," said Robert Haley, commander of the Fallbrook Sheriff’s substation. "Apparently, he had been causing a disturbance in the bar and had been drinking."

Javier Hernandez, the 28-year-old victim from Fallbrook did not desire to prosecute, and did not want to cooperate with deputies, said Haley.

"Hernandez refused treatment by North County Fire, and when we went to Palomar Hospital to get a statement, he did not want to have Advertisement

a report taken."

While interviewing witnesses at the scene, deputies discovered that the suspects who assaulted Hernandez were said to be either white or Hispanic, but positive identifications were not available.

Though a reader reported the fight to the Village News, Haley stated no details that would have been helpful about the incident were given to interviewing deputies.

"It’s funny; people don’t tell us anything. I understand people’s reticence to get involved. They don’t know if at some point someone will try and fight them later on when they try to be a good witness," said Haley. "Unfortunately, when the victim is uncooperative, there is not much we can do. The district attorney will not prosecute or file a case. Still, it’s important to communicate everything you can so we can piece these cases together a lot more quickly."

Haley stated that the case had no relation to gang activity.

"It was just a case of people drinking alcohol at bars and having a disagreement," he said.

Lets see, it was 10 on 1 and they could be whites or hispanics?? 10 on 1 tells you right there, unfortunately. No need to prosecute, he will get his own revenge in time, unfortunately.

Stay safe Fallbrook and God Bless.

This was a bar fight. That's it. OMG, if the Beer Hut were still open, this wouldn't even register on their scuffle meter. I'm talking '70's Fallbrook and this was a much freer country. Things weren't all about race. Tom Metzger was living on Sunbeam Lane fixing TVs in an all Mexican neighborhood off Old Stage Rd. a street full of very fine families and he was raising a stink about race and all, but not in his own backyard. This was before Political Correctness and Hate Speech. A fight between two (or however many) guys was most likely regarding some woman or a personal attack on one's character. Today, every slight has to be addressed by the cops and the district attorney.

Haley called it right. "It was just a case of people drinking alcohol at bars and having a disagreement."

Sorry, but this was just not news worthy.

It was 10 or more against 1...the victim was rammed head first in to a car 6 times. When he was down his head was used as a soccer ball,( Kicked at least 5 times) This is just wrong, I do not know anyone involved, it happened so fast..This happened at the bar across the street from Jack-in the-box.. not sure if I say the name the paper will post. Its a sad day when it takes more then one on one and he is being kicked when down!!!

On a daily basis people are pouring themselves out of that bar! Perhaps instead of dismissing this as "just people drinking and having a disagreement". The serving practices of that bar should be addressed! It is afterall a residential area!

Reading comprehension is lacking yet again. Nowhere in this article does it state that this incident was a 10 on 1 beat down.

I like #3's post the best...

I always have a problem with cowards doing the multiple people beat downs that seem so prevalent. Not that I condone a beating, but when two guys need to throw blows why can't it stay that way - one on one? No kicks to the head/face allowed. Actually, NO kicking for that matter at all! It use to be only women kicked during a fight and that was usually against a guy that was hassling them (which I say is/was good to go). Also, no continuous pummeling to the face once the guy is down and has given up. You won, be happy. Then, unless you really hate one another or the reason for the fight was quite egregious, you shrug it off and sometimes buy each other a beer. But, that's how it use to be for the most part.

I also like how so many people "know" or "witnessed" what happened. Sometimes it makes you wonder. If comment #11 is correct then maybe I will sway a little off my previous paragraph - J/K LOL. But, if true - the guy should NOT be in Fallbrook. We have enough of our own home grown bangers to love and adore.
